1. Acceptance of Terms

By accessing and using the designmd.app website ("Site"), you agree to these Terms of Use. If you do not agree with any part of these terms, do not use the Site.

2. Description of Service

designmd.app is an open platform that provides DESIGN.md files — design system documents in Markdown format — for use with AI agents. The Site offers a documented library, setup guides, technical articles and related tools.

3. Content License

DESIGN.md files in the library are licensed under Creative Commons Attribution 4.0 International (CC BY 4.0). You may copy, modify, distribute and use the files for any purpose, including commercial, as long as you credit designmd.app.

4. Permitted Use

• Copy and use DESIGN.md files in personal and commercial projects
• Modify and adapt files to your needs
• Share files with third parties, respecting the license
• Use blog and guide content as reference

5. Restrictions

• Do not reproduce the entire Site to create a competing service
• Do not use automated mechanisms (scraping, bots) that overload the server
• Do not remove authorship attributions or license notices
• Do not use the Site for illegal activities

6. Third-Party Trademarks and Brand References

The "Real Brands" section contains design tokens (colors, typography, spacing, border-radius) extracted exclusively from publicly visible CSS of third-party websites. These are technical facts observable by anyone using standard browser developer tools.

designmd.app is not affiliated with, endorsed by, sponsored by, or officially connected to any brand referenced in the Real Brands section. All brand names, trademarks, and logos are property of their respective owners.

DESIGN.md files describe visual patterns for educational and technical reference only. They do not reproduce copyrighted content (photographs, illustrations, marketing copy, logos, or proprietary source code). Preview pages use fictitious content and do not impersonate the referenced brands.

If you are a trademark owner or authorized representative and believe content on this Site infringes your rights, you may request removal per Section 9 of our Privacy Policy and the LGPD framework. We respond to removal requests within 15 business days.

7. Disclaimer and Limitation of Liability

The Site and its content are provided "AS IS" and "AS AVAILABLE", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, designmd.app, its owner, contributors, and affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, business opportunity, or reputation — arising from:

• Use or inability to use the Site or any DESIGN.md file
• Inaccuracy in design tokens compared to the current state of a brand's website
• Any claim by a third party, including trademark owners
• Decisions made based on information on the Site
• Interruption, suspension, or discontinuation of the Site

In jurisdictions that do not allow exclusion of liability for consequential damages, liability is limited to the maximum extent permitted by law. Total aggregate liability shall not exceed BRL 100.00 (one hundred Brazilian Reais).

8. Indemnification

You agree to indemnify and hold harmless designmd.app and its owner from any claims, damages, losses, and expenses (including attorney fees) arising from your use of the Site or violation of these Terms.

9. Governing Law

These Terms are governed by the laws of the Federative Republic of Brazil. Disputes shall be resolved in the courts of São Paulo, SP, Brazil.
